General Terms of Business and Stipulations for Use

of the home4arts Institute of Arts (defined as IOA in the following):

| Registration |
- By registering in the customary manner via registration form
and upon receiving a confirmation of approval from the IOA (home4arts),
the user therewith consents to a contract for the use of services.
In order
to use the services available, the user agrees to provide truthful,
up-to-date, exact and complete information with respect to themselves
and in accordance with the registration form. Additionally the
user agrees to judiciously notify the Institute of Arts about
any changes to this information.

The IOA (home4arts)
respects all applicable data protection legislation when processing the user information.

| Rights and Obligations |
- The user is liable for any unauthorized use of his account.
The user
is obligated to protect his or her account against any form of use through third parties.
The personal
password which was selected, may not be passed on in any form.
The user
may not attempt to gain unauthorized access to other accounts
through cracking of codes, illegal procurement of passwords or other methods.
The user
may not associate the IOA (home4arts) services and its users in
connection with surveys, competitions, chain letters, junk emails,
mass advertising, spamming or all other unwanted correspondence of commercial or other nature.
The user
may not in any way infringe upon the legal rights (i.e. privacy
and individual protection) of other persons through slander, annoyance, abuse or intimidation.
The user
must in all cases respect the privacy of others and may not publish,
make public, upload or distribute any contemptible, slanderous,
obscene, immoral or illegal material or information.
The user
may not transmit, upload, download or in any other way make use
of contents which contain pictures, photos, software or other
material, through which the rights of third parties (in particular
copyrighted and/or patented information) are violated. The incorporation
of hyperlinks or other technical links which lead to websites
containing contents contrary to the terms of the agreement, are
also considered as invalid and unauthorized. In particular, any
contents containing discriminating racist annotations, hostile
remarks regarding foreigners and pornographic or other material
of a sexually degrading nature is especially deemed as a violation of this agreement.
The user
may not upload any files which are damaged or afflicted with a
virus and/or comparable software or programs, which could impair other computer systems..
The user
may not prevent other users from employing communication services and/or limiting its utilisation.
The user
may not infringe upon applicable laws or legal regulations and
may not incorporate or distribute any contents which do not comply
with the principles of fair competition and consumer protection,
copyright and commercial patent rights of third parties, data
protection, relevant criminal regulations and/or general laws,
regulations for the protection of youth and the right of personal
honour (altogether: "contents contrary to the terms of the agreement").

| General Information |
- The IOA (home4arts) reserves the right too delete any illegal,
discriminating, sexist, morally despicable or otherwise precarious
contents and to pass these on to judicial or official agencies
as well as criminal prosecution authorities.
If an offence
and/or a justified suspicion of an offence against these terms
of condition exists, the IOA (home4arts) is warranted and obligated
to exclude the respective user from utilization of the system
and to IMMEDIATELY file a criminal complaint against the person (or person's group).
These general
terms of business and stipulations for use, and, any legal disputes
arising from the contractual relationship between users and the
IOA (home4arts) are subject to the legislation of the Federal
Republic of Austria under exclusion of the obligation to retreat from purchase.
For all disputes
between the IOA (home4arts) and the user, to the extent permissible
Vienna is agreed upon as the sole area of jurisdiction.
The IOA (home4arts)
websites and services and the information contained therein, are
regularly altered and updated. They may display mistakes or typographic
errors. The IOA (home4arts) does not have any influence on the
transmission of data by means of the internet. Therefore the IOA
(home4arts) cannot guarantee that messages sent will correctly
reach the receiver, to the extent that during the transmission
any errors arise externally from the main server. The IOA (home4arts)
is automatically released from any liability, performance obligations
and guarantees in the case of unforeseeable events such as higher
force, strikes, loss of transmission or other disturbances which
were not directly brought about by the IOA (home4arts).
The Institute
of Arts will not whatsoever accept liability for any potential
damages caused through the use of the websites and services at
www.home4arts.com and www.instituteofarts.net. |
| Use by the IOA - home4arts |
- The user grants the IOA (home4arts) the time and spatially unrestricted,
non-exclusive, irrevocable, complimentary right to use and commercially
draw on the integrated contents of his or her photo pages, chat
or other forums within the framework of the home4arts site.
In particular,
the user grants IOA (home4aerts) the right to reproduce the contents,
to convey and distribute them under any kind of name, to change,
develop or translate the contents and to make public these changes,
developments or translations as well as the contents, by means
of transfer via wired or wireless technology including interactive
areas. In addition, the contents may be rented to third parties
and/or licensed to them in any other way.

| Notice of Termination for Use of the Home4arts Project Forums (with password) |

Any notice of termination must be sent per email to office@home4arts.com
or in writing to the following address:

Immediately upon receiving the termination notice, the user is denied access to all of his data. |
